Terms and Conditions - Lawn Army
Welcome to Lawn Army! By utilizing our services, you agree to the following terms and conditions. Please read them carefully.
Service Scope
Lawn mowing services are provided to a height of 2 inches, unless a different height is requested and agreed to by the customer. Our service includes trimming around all obstacles present in the lawn, edging of walkways and driveways, and blowing of grass clippings from those surfaces.
For clarity, our service does not extend to work within flower beds, areas covered by mulch, or the removal of weeds growing in pavement joints.
Access and Site Readiness
To ensure efficient and safe service, clients must provide clear and unobstructed access to all areas of the property scheduled for service. This includes, but is not limited to, ensuring gates are unlocked or access codes are provided, pets are secured, and movable items like toys, furniture, hoses, and excessive debris are removed from the lawn area prior to our arrival. If our team is unable to complete the service due to obstructed access or unready conditions, a trip fee may be assessed, or the service may need to be rescheduled, potentially resulting in a skipped service for weekly customers or a delayed make-up for bi-weekly customers.
Client Responsibilities & Liability
To ensure efficient service, clients are responsible for providing unobstructed access to the lawn area and must notify us of any alterations to the property that may affect service provision.
Lawn Army will not be held liable for property damage or personal injury unless such damage or injury results directly from our gross negligence. This includes, but is not limited to, damage to items hidden or obscured by overgrown grass, tall weeds, or excessive debris that were not visible to our team during service. It is the client's responsibility to ensure the lawn area is free of such hazards prior to service.
Underground Obstructions
While our team takes reasonable care, Lawn Army is not responsible for damage to unmarked or unmapped sprinkler heads, low-voltage landscape lighting wires, invisible pet fences, or other buried items not readily visible or disclosed by the client. It is the client's responsibility to clearly mark or communicate the presence and location of such items prior to any service.
Pet Waste Removal and Fees
Clients are responsible for removing all pet waste from the lawn area before our scheduled service. For the safety of our team, to prevent damage to our equipment, and to maintain a sanitary work environment, we will not intentionally mow around or over visible pet waste. If our team encounters pet waste that significantly impedes service, requires cleanup due to accidental contact with equipment, or otherwise necessitates additional time and sanitation efforts, a $10 pet waste cleanup (for our equipment) fee will be assessed. Repeated instances of excessive pet waste may result in service interruption or termination.
Electrical Cables and Wires
Clients are solely responsible for identifying and clearly marking the location of all electrical
cables, low-voltage lighting wires, invisible pet fences, sprinkler control wires, or any other
type of wire, whether buried or on the surface, that are not installed to current code and/or
are not buried at a sufficient depth to allow for safe mowing.
Lawn Army will not intentionally mow within 12 inches of any visible or known electrical
cables
or wires to mitigate risk. We cannot be held liable for damage to unmarked, unmapped, or
improperly installed (e.g., too shallow, exposed) electrical cables, wires, or related
components. It is the client's responsibility to ensure such items are protected or clearly
marked prior to service to allow our team to safely work around them. Any repairs to such items
damaged due to insufficient marking or improper installation will be the sole financial
responsibility of the client.
Pre-existing Damage & Property Disclaimers
Lawn Army is not responsible for pre-existing damage to the property, including but not limited to, damaged irrigation lines, broken fences, unsecure pavers, or weak landscape elements. Clients are encouraged to point out any areas of concern prior to service. We also advise clients to secure or remove any fragile or valuable items (e.g., small ornaments, glass decor, unanchored lighting) from the lawn area, as Lawn Army will not be held liable for damage to such items that are not typically designed to withstand lawn care operations.
Clipping Management
Unless otherwise specified and agreed upon, all grass clippings will be mulched and left on the property. If bagging and removal of clippings is required, this service must be requested in advance and may incur an additional fee.
Uneven Terrain and Cut Quality
Clients acknowledge that the quality and evenness of the lawn cut are significantly influenced by
the underlying terrain of the property. Lawn Army cannot guarantee a perfectly uniform cut on
lawns
with uneven surfaces, significant undulations, depressions, or high spots.
While our team utilizes professional equipment and techniques, turf in these areas may
appear
unevenly cut or show variations in height due to the mower deck's inability to perfectly follow
extreme contours. Lawn Army will not be held responsible for an uneven cut that is a direct
result
of the property's natural or man-made uneven terrain. For optimal results on severely uneven
lawns,
grading or leveling of the property may be recommended, which falls outside the scope of our
standard lawn mowing service.
Risks of Ruts and Scalping on Inclines/Soft Ground
While Lawn Army takes every reasonable precaution to minimize impact, clients acknowledge and
accept
the inherent risks associated with lawn care on properties with inclines, slopes, or areas of
soft/saturated ground.
Due to the weight of mowing equipment and the need to achieve a uniform cut, there is a
possibility
of:
Ruts or Tire Marks: Especially during or after periods of rain when
the ground is soft,
heavy
equipment can leave temporary indentations or tire marks.
Scalping: Areas with uneven terrain, steep inclines, or hidden
obstructions may be susceptible
to
minor scalping (cutting the grass very short, sometimes exposing soil) as our equipment
traverses
these areas.
Lawn Army will not be held responsible for minor ruts, tire marks, or instances of
scalping that
occur as a result of normal mowing operations on inclines or excessively wet/soft ground
conditions.
It is the client's responsibility to manage drainage on their property and to communicate any
known
areas of extreme softness or hidden irregularities that might exacerbate these issues.
We will,
however, always strive to use best practices to mitigate these occurrences.
Short Notice Cancellation Policy
To ensure efficient scheduling and compensate for lost time, any service cancellation made with less than 24 hours' notice prior to the scheduled service time will incur a $5 cancellation fee. This fee helps offset the costs associated with preparing for your service and the inability to fill that time slot on short notice.
Skipped Services
If a client wishes to skip a regularly scheduled service for reasons other than inclement weather
(e.g., vacation, recent personal mowing), they must notify Lawn Army with a minimum of 24 hours'
notice prior to the scheduled service time.
Weekly Customers: A skipped service means that particular week's
service is missed, and
your
regular weekly schedule resumes the following week.
Bi-Weekly Customers: Skipping a service will mean your lawn will be
significantly
longer on
the
next scheduled visit. Depending on the growth, a surcharge may be applied for the additional
time
and effort required to bring the lawn back to standard length. Repeated skipped services may
require
a re-evaluation of your service pricing or frequency.
Photography & Marketing Consent
Lawn Army reserves the right to take photographs of properties before, during, and after service for purposes of quality control, service documentation, and marketing. These photos may be used on our website, social media, or other promotional materials. Property addresses or client-identifying information will not be disclosed without explicit consent. If you prefer that photos of your property not be used for marketing purposes, please notify us in writing.
Failed Service Visit / Access Issues
In the event our crew arrives at the scheduled property for service, but access is not possible due to client-related issues, a $15 Failed Service Fee will be assessed. Client-related issues include, but are not limited to: locked gates (without prior code provided), unsecured pets, excessive obstacles not removed from the service area (e.g., large furniture, significant debris), or any other condition preventing our team from safely and efficiently completing the scheduled service. This fee compensates for the time, fuel, and operational costs incurred for the dispatched visit. The scheduled service will need to be rebooked for a later date, subject to availability.
Rain & Rescheduling Policy
Please note that due to inclement weather, particularly rain, we reserve the right to reschedule or cancel your service for that week to ensure the safety of our team and the quality of our work. We will communicate any changes as soon as possible.
- For Weekly Customers: In the event of a rain-related cancellation, your service for that specific week may be skipped. We will resume your regular weekly service on your next scheduled date.
- For Bi-Weekly Customers: If your service is cancelled due to rain, we will make every effort to provide a make-up service day within the same week or the following week. This make-up service will not alter your established bi-weekly rotation; your subsequent scheduled service will remain on its original date, even if the make-up service falls outside of your typical service week.
Service Day vs. Specific Time Guarantee
While we strive to maintain consistent service routes and schedules, Lawn Army cannot guarantee a specific arrival time on your scheduled service day. Our services are scheduled by the day, not by the hour. Factors such as weather conditions, equipment maintenance, traffic, and unforeseen circumstances at previous jobs may cause variations in our daily arrival times. We appreciate your understanding and cooperation regarding our scheduling flexibility.
Satisfaction & Complaint Protocol
Lawn Army strives for 100% customer satisfaction. If you are not completely satisfied with a service, please notify us within 24 hours of service completion. We will promptly review your concerns and, if deemed appropriate, arrange for a re-service or provide a suitable resolution. Claims made after 24 hours may not be honored.
Payment Terms
Payment for services rendered is required at the time of completion. A late fee of 10% will be applied to any payments not received within 7 days of service.
Service Fee Adjustments
Lawn Army reserves the right to adjust service fees with a minimum of 30 days' prior notice to the client. Any changes will be communicated via text, email or through the client portal. Continued use of our services after receiving notification of a fee adjustment will constitute acceptance of the new pricing.
Communication Policy
For efficient communication regarding scheduling changes, service updates, or any property-related issues, Lawn Army primarily communicates via text message and email. Please ensure your contact information on file is current. While we strive to provide timely notifications, it remains the client's responsibility to check for updates.
Right to Refuse or Terminate Service
Lawn Army reserves the right to refuse service to any client or to terminate ongoing service agreements if, in our sole discretion, the property presents unsafe working conditions, if there are repeated violations of these terms and conditions, in cases of non-payment, or if our staff experiences harassment or unreasonable demands. In such instances, reasonable notice will be provided where possible, and any outstanding balances will be due immediately.
Holiday Schedule
Lawn Army observes major national holidays. Services scheduled on these days will be rescheduled to the nearest possible working day. We will notify clients in advance of any holiday-related service adjustments. Your regular billing cycle will not be affected by these rescheduling adjustments.
